Terms & Conditions

Please find below the full terms and conditions for Argyll Hotels.

1. Agreement

a) The terms and conditions herein applies to all good and services supplied by Net Visuals (UK) of Church Terrace, Tarbert, Argyll, PA29 6UR
b) We may at times convenient to us change these terms and conditions without prior notification. Please ensure you read these prior to every order.
c) A contract only exists between you, the customer and us, the supplier after we have provided a written quotation or you have agreed the price of sale of goods either by comitting to an online transaction or by written acceptance Failure to do so negates a supply of goods or services at any time.
d) Upon completion of an order by any of the methods described in 1c you will be sent an email confirming the services or products purchased along with an order number and final value to be paid.
e) Some purchases may require a deposit or payment in full prior to processing your order. If this is the case you will be notified in writing with your order details or during the order procedure.
f) You have the right to cancellation subject to section 2.

2. Cancellation

a) You have the right to cancel your order within 7 working days from the date and time of your order.
b) You must notify us in writing within 7 working days of your cancellation by email, fax or letter specifiying the products and services you no longer require and your order number.
c) Net Visuals are not responsible for undelivered email, faxes or mail and reserve the right to reject cancellation if not recieved within 7 working days.

3. Price & Description Of Goods

a) All goods and services are subject to availability.
b) All listings on this website are subject to availability and our discretion.
c) In the event of a pricing or description error you will be notified as soon as possible and be given the option to choose an alternative option at the new price quoted, wait for that product or service to be re-stocked or cancel your order in full or part.

4. Membership

a) You are required to subscribe to the 'Nocturnal Indulgence' collection prior to listing.
b) A one of annual membership fee of £29.99 + VAT is charged before you can list any accommodation on the Nocturnal Indulgence websites.

5. Payment

a) Goods and services can be paid by any of the methods shown on our website or by any method shown in your quotations.
b) Payment must be made at the time of purchase unless another expressed written agreement exists with Net Visuals.
c) If for any reason payment by you is null or void due to unforeseen cicrumstances, payment may be spread over a period and for the amount owed between you, the customer and us, the supplier. This must be agreed in writing or the goods must be returned unopened where possible to our registered office address.
d) Invoice terms are strictly 14 days from the date of invoice for credit account holders. Interest maybe charged for late payment.
e) Where a payment has not been received we reserve the right to cancel services which may result in the loss of valuable items, service, or custom. It is the customers responsibility to ensure that payment is supplied within the payment terms.
f) We may remove our 14 day credit period at any time.
g) Late payments will automatically reduce or remove any credit facility or post work invoice terms. We may refuse to undertake work or supply services to customers who are unable to meet our payment terms.
h) Non-credit and new customers are expected to pay for goods or services on finalising a contract or order. Until payment is received there is no obligation for Net Visuals to undertake any work.

6. Guarantee

a) All goods and services are under warranty from the date of order, where the goods or services have not suffered wear or tear, where the goods or services are not computer software, where good or services have not suffered damage by accident, natural disaster, wilful damage, negligence or improper repair or installation by an unqualified engineer.
b) If goods or services supplied do not arrive in perfect condition and/or are damaged preventing correct or full use you should notify us within 10 days.
c) If goods or services develop a fault whilst under warranty you must notify us immediately and return the product to us for testing. We will where possible repair the product and return or issue a new or replacement component where possible. Where the goods are electronic we will investigate the fault and repair (subject to subscription terms (3g).

7. Liability Limitation

a) Net Visuals do not accept any liability for loss or damage as a result of goods and services supplied to you, the customer. All products and services are purchased as described and for the purpose therein.
b) When possible Net Visuals will provide secure anti-fraud payment and accept no liability for the theft of your personal information or credit card out of our reasonable control.
c) Liability is not limited for death by negligence by Net Visuals within the terms and conditions.

8. Liability Limitation

a) Net Visuals will take all reasonable precautions to keep the details of your order, payment details and personal information secure and restricted to key personnel. Your personal information will not be given to any third party prior to your given written agreement or consent.

9. Product Images and Templates

a) Product and Service Images and Templates may differ from the actual ones displayed in published material or on our website and will be subject to change without our prior notification.
b) Where possible you will be notified that the image or sevrice will be different from usually displayed.

10. Non Payment

a) As a result of non-payment or a failure to make an agreed payment, Net Visuals may suspend a service or recover products purchased. You may be liable for court costs and legal expenses in the event of dispute following non-payment for a sustained period.
b) Any dispute arising from the contract existing between you, the customer and Net Visuals, the supplier, will be dealt with under Scottish Law and Scottish courts unless otherwise agreed with Net Visuals prior to legal action. Net Visuals will undertake where it is possible all precautions to protect you, the customer from fraud, injury, death or loss of earnings.

11. Acceptance & Requirements

a) By subscribing to our websites you understand and accept in full that web traffic is varied and may fluctuate up and down and as such the performance of our site and your advertising may also fluctuate.
b) By subscribing to our websites you also understand accept that we do not guarantee you will receive enquiries and additional business however it is the aim of this website to do that.
c) You are required to retain statistics and details of enquiries and bookings at all times so we are able to measure your performance and make our service fair.
d) Your listing position may be altered at any time either by alphabet or by contract commitment by competitors. You may alter your subscription to compete.

12. Linking & Logo Display

a) By becoming a member of Nocturnal Indulgence you have permission to display one or more of our logos on your website linking to www.netvisuals.co.uk/nocturnalindulgence/
b) It is a requirement of listing that you must at least feature a link from your website to ours as part of membership requirements, home page logo and link preferred.
c) You may also promote our brand by linking to us on any of your websites or independent websites
